Federal Court Rules Against ATF on Forced Reset Triggers

A few weeks back gun owners won a huge victory when a federal court in Texas ruled that the ATF overstepped their boundaries by classifying forced reset triggers as machine guns. The lawsuit, brought by American Action Fund’s friends at the National Foundation for Gun Rights was a huge success for gun owners.

 

The ruling was not a surprise for gun owners or literate people (which apparently the ATF is not) who could read the National Firearms Act. A machine gun, as defined by the NFA, requires multiple rounds to be fired with one function of the trigger without reloading — which is not how a forced reset trigger functions. An FRT simply resets the trigger immediately after action, allowing a shooter to pull the trigger again potentially faster than they would without the reset action of a spring.

In the ruling Judge O’Connor trashed the Biden Administration for their unlawful attempt to seize powers from the legislative branch for the purpose of harassing lawful gun owners. 

 

“Every year, our country commemorates the revolution waged against a tyrannical executive. To safeguard against future tyranny, our founding documents designed a system that prevents undue concentrations of power in order to protect important rights and to ensure that a legislative consensus is reached before enacting laws on the most important issues in society,” O’Connor said.

 

This was clearly a huge victory for gun owners who saw similar overreaches by the ATF struck down in recent months, including the ban on bump stocks.

 

The Second Amendment is constantly under attack by anti-gun zealots at the local, state, and federal level. American Action Fund will always be ready to fight back with our allies in the gun rights movement.
