You broke the law – Do you know which one?

“There are so many federal criminal laws that no one, including the Justice Department, the principal federal law enforcement agency, knows the actual number of crimes.”

 

Supreme Court Justice Neil Gorsuch cited this shocking quote in his dissent on a 2018 case. 

 

The reality Americans live with today is that every one of us has likely violated a law, rule, or regulation without knowing we even did so. 

 

Ultimately, this unintentional violation of some silly government edict could be used by government tyrants to wage lawfare against their political opponents or make life more difficult for the average citizens. 

 

This overcriminalization isn’t just a result of too many laws (while that is undoubtedly the case). Too often, Congress cedes its authority to unelected bureaucrats, resulting in a myriad of rules and regulations that most don’t even know exist.

 

Unfortunately, many states have also implemented this model, allowing the administrative state to determine what actions constitute crimes.
