Unelected Government Bureaucrats Demolish Homes Without Court Approval

Our partners at the Institute for Justice published an article by Phillip Suderman that highlighted a concerning issue in Georgia.
Eric Arnold, a tradesman from New Jersey had recently purchased a home in Georgia to be closer to family and was actively repairing the property when he was informed by a neighbor that a demolition crew was setting up at his property. The county did not notify him of their action which they claim to have the right under the guise of “code enforcement” to remove “blight.”
Arnold appealed for two months to no avail, only to have his property demolished by unaccountable bureaucrats despite the proof that he owned the property and was actively fixing and restoring it.
Now, along with the Institute for Justice, Mr. Arnold is suing the county for due process violations in the destruction of his property.
“Property rights are the bedrock of American society,” said IJ Attorney Christie Hebert. “To arbitrarily destroy Eric’s house without even the courtesy of letting him know is wrong ethically and wrong under the law.”
